Agreement to Terms

By downloading, installing or using any Gamiak application, or by accessing this website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services.

License

Subject to your compliance with these Terms, Gamiak grants you a non-exclusive, limited, revocable, non-transferable license to access and use the Services for your own personal, non-commercial entertainment purposes. You agree not to use the Services for any other purpose.

You may not:

• Copy, modify, or create derivative works based on the Services or any content therein
• Reverse engineer, disassemble, decompile, decode or otherwise attempt to derive or gain access to the source code of the Services
• Remove, delete, alter or obscure any trademarks, warranties, disclaimers, or intellectual property or proprietary rights notices from the Services
• Use the Services to transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware
• Use any robot, spider or other automatic device, process or means to access the Services for any purpose, including monitoring or copying any of the material on the Services
• Use the Services in any way that violates any applicable federal, state, local or international law or regulation
• Exploit, distribute or publicly communicate any error, miscalculation or bug which gives an unintended advantage
• Use or attempt to use another user's account without authorization
• Attempt to circumvent any content-filtering techniques we employ, or attempt to access areas or features of the Services that you are not authorized to access

The Services may contain links to third-party websites or resources. We provide these links only as a convenience and are not responsible for the content, products or services on or available from those websites or resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.

Some of our Services may include content from third-party companies. We do not endorse, control or take responsibility for any third-party content, advertising, products or other materials.

Age Requirements

You must be at least 18 years of age, or the age of majority in your province, territory or country, to use the Services. Individuals under the age of 18 may use the Services only with the involvement and consent of a parent or legal guardian. Users under the age of 13 may not use the Services without verifiable parental consent as required by applicable law, including COPPA and GDPR.

Virtual Currency and Virtual Items

Our Services may include a virtual currency (such as coins, gems or points) or virtual items (such as power-ups or additional content) that may be purchased for real money or earned through gameplay. Virtual currency and virtual items:

• Have no monetary value and cannot be sold, traded or transferred for real money or items of value outside of the Services
• Are not your personal property
• Cannot be transferred between accounts
• May be modified, managed or eliminated by Gamiak at any time without notice or liability to you

All sales of virtual currency and virtual items are final. Gamiak does not offer refunds for any purchased virtual currency or virtual items, except where required by applicable law. To the extent permitted by applicable law, Gamiak retains absolute discretion over whether to provide refunds.

Intellectual Property

The Services and their entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) are owned by Gamiak, its licensors or other providers of such material and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication or distribution

By submitting, posting or displaying content (including but not limited to game recordings, screenshots, videos, reviews or feedback) relating to the Services, you grant Gamiak a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute such content in any existing or future media. You also grant Gamiak the right to sub-licence these rights.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER GAMIAK NOR ANY PERSON ASSOCIATED WITH GAMIAK MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE SERVICES.

WITHOUT LIMITING THE FOREGOING, NEITHER GAMIAK NOR ANYONE ASSOCIATED WITH GAMIAK REPRESENTS OR WARRANTS THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL GAMIAK, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

Indemnification

You agree to defend, indemnify and hold harmless Gamiak, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Governing Law and Jurisdiction

These Terms and your use of the Services are governed by and construed in accordance with the laws of Spain, without giving effect to any choice or conflict of law provision or rule.

Any dispute, controversy or claim arising out of or relating to these Terms or the breach, termination or invalidity thereof shall be finally settled by arbitration administered by the International Chamber of Commerce (ICC) in accordance with its Rules of Arbitration. The seat of arbitration shall be determined by the arbitral tribunal. The language of the arbitration shall be English.

Any cause of action or claim you may have arising out of or relating to these Terms or the Services must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action or claim is permanently barred.

Changes to These Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
